OF THE
CITY OF KEWAUNEE COMMON COUNCIL
REGULAR MEETING
SEPTEMBER 12, 2005

Present: Mayor Jeanquart, Alderman Blaha, Vollenweider, Brewster, Zenner, Muellner, Rabas, Schneider

Absent: Crabb (excused)

Others: Administrator Kranz, Public Works Director Balleine, Don & Willard Kickbusch, Don Thor, Gene Baumgartner, Steve Mastilar, Mark Sisel, Paul Cramer, Lana Lesh, Jane Sanderfoot, Barb Ludlow

Mayor Jeanquart called the meeting to order at 7:00 p.m. whereas the Pledge of Allegiance was recited followed by meditation.

Representatives from the Manitowoc YMCA appeared before the Council and presented their Summer Recreation Report for the year.

Steve Mastilar appeared before the Council to voice his concerns on the proposed weed violation ordinance changes. The primary concern was the change in height from 12 to 6 inches. Correspondence from Don Kickbusch, Richard Mlady, and David Olson were also introduced stating their same concerns on the new height change.

The Council received the Finance Committee minutes of August 8, 2005.

Vollenweider moved and Brewster seconded to approve the issuance of Operator’s Licenses as submitted. Motion carried unanimously.

Vollenweider moved and Brewster seconded to approve the issuance of Temporary Class"B" Retailer’s Licenses as submitted. Motion carried unanimously.

Vollenweider moved and Muellner seconded to approve the August 2005 Accounts Payables in the amount of $511,125.95. Upon a roll call vote, motion carried unanimously.

The Council received the Public Works Committee minutes of September 6, 2005.

Schneider moved and Muellner seconded to approve the purchase of a snow blower from Kewaunee Small Engine Repair in the amount of $909.96. Upon a roll call vote, motion carried unanimously.

The Council received the Tug Ludington Committee minutes of September 1, 2005.

Blaha moved and Rabas seconded to approve the Regular Council Meeting minutes of August 8, 2005 as submitted. Motion carried unanimously.

Schneider moved and Zenner seconded to adopt RESOLUTION NO. 951-05, RESOLUTION FOR URBAN FORESTRY GRANT PROGRAM. Motion carried unanimously.

Discussion occurred on the proposed weed violation ordinance regarding the length of weeds/grass before a violation exists. Following discussion, Rabas moved and Muellner seconded to amend the language of Ordinance No. 537-05 to allow for 8" in height on developed lots and 12" in height on undeveloped lots. Upon a roll call vote, motion carried unanimously.

Schneider moved and Rabas seconded to introduce the second reading and adoption with changes of ORDINANCE NO. 537-05, AN ORDINANCE AMENDING CHAPTER 86 OF THE MUNICIPAL CODE OF KEWAUNEE, WISCONSIN, ENTITLED "VEGETATION". Motion carried unanimously.

Blaha moved and Zenner seconded to introduce the second reading and adoption of ORDINANCE NO. 538-05, AN ORDINANCE AMENDING CHAPTER 62 OF THE MUNICIPAL CODE OF KEWAUNEE, WISCONSIN, ENTITLED "STREETS, SIDEWALKS AND OTHER PUBLIC PLACES". Motion carried with Rabas voting nay.

Rabas moved and Vollenweider seconded to introduce the first reading of ORDINANCE NO. 539-05, AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL CODE OF KEWAUNEE, WISCONSIN, ENTITLED "ELECTIONS". Motion carried unanimously.

Schneider moved and Blaha seconded to introduce the first reading of ORDINANCE NO. 540-05, AN ORDINANCE AMENDING CHAPTER 90 OF THE MUNICIPAL CODE OF KEWAUNEE, WISCONSIN, ENTITLED "WATERWAYS". Motion carried unanimously.

Vollenweider moved and Muellner seconded to introduce the first reading of ORDINANCE NO. 541-05, AN ORDINANCE AMENDING CHAPTER 86 OF THE MUNICIPAL CODE OF KEWAUNEE, WISCONSIN, ENTITLED "VEGETATION". Motion carried unanimously.

Schneider moved and Muellner seconded to introduce the first reading of ORDINANCE NO. 542-05, AN ORDINANCE AMENDING CHAPTER 62 OF THE MUNICIPAL CODE OF KEWAUNEE, WISCONSIN, ENTITLED "STREETS, SIDEWALKS AND OTHER PUBLIC PLACES". Motion carried unanimously.

Under public comment, Willard Kickbusch stated that sidewalk grades need to be properly established by the City with the expense being proposed to be the City’s responsibility.

Vollenweider moved and Muellner seconded to adjourn the meeting at 8:15 p.m. Motion carried unanimously.
